Loft Policies
Agents and/or Homeowners are expected to have the property cleaned and staged prior to the photo shoot as all properties will be shot “AS IS”.
Prior to or at the photo session, the customer should identify important aspects of the property or areas that should not be photographed. The photographer will use her best judgment, experience, and creativity to decide how to best photograph the property.

Cancellations/Rescheduling:

Minimum of 12 hours notice is required for cancellations and rescheduling. For reasons other than weather, a $50 cancellation fee will be charged if scheduled shoot is canceled within 12 hours. Every effort will be made to accommodate a rescheduling. “No Shows” will be charged a cancellation fee of $50. Properties that are not photo-ready and need to be rescheduled will be charged an On-Site cancellation fee of $50.

If, in the opinion of the Photographer, inclement weather or other adverse conditions prevent thecreation of photography that meets the artistic standards of the photographer, Photographer may electto use an alternate location or to reschedule the photography.

Post-Shoot:

Images will be hand-selected and individually retouched for optimum quality. Delivery estimate is 1 to 2 business days, unless otherwise specified.

Images are archived for up to one year and purged after one year. LOFT reserves the right to impose archive fees for requested images during the one year.

Rights/Usage Policies:

All listing images created for an agent may be used by that agent for any and all marketing associated with the property as well as the agent’s self promotion. The photos may also be used by the agent’s parent company for the sole purpose of marketing the specific property photographed for the duration of the listing, and must not be distributed to a third party without permission. All images will remain owned and copyrighted by the photographer. The photographer maintains the right to redistribute the photos at their discretion, and licensing is granted to the agent and the agent’s parent company only and not to any third party. Distribution of the of the images by the agent/parent company to a third party, including but not limited to architects, builders, stagers, designers, sellers or buyers, is strictly prohibited unless approved in writing by the photographer.

All materials are guaranteed to be as specified and in accordance with the details and locations discussed.

Reshoots:

Reshoots may be requested for a nominal fee. Deliverables include agreed upon number digital images. Images will not be delivered until balance is paid in full. Reshoots are subject to the following restrictions: Reshoots will not be issued for circumstances surrounding client discrepancies such as furniture misplacement, burned out lightbulbs, etc. Reshoots requested under client discrepancies will be subject to the full amount of a Photo Session. If the Photographer fails to deliver images other than what was specified in the directions, a reshoot will be issued and the client will pay zero additional expenses. For any reshoot required because of any reason outside the  control of client, specifically including but not limited to acts of God, nature, war, terrorism, civil disturbance or the fault of a third party, Photographer will charge no additional fee, and client will pay all expenses. Cost for photoshoot is referenced in a requested estimate.

The charges are based on the Photographer’s Standard Price List and include cost of usage license. This price list is adjusted periodically and future orders shall be charged at the prices in effect at the time when the order is placed. There are no warranties, express or implied. The image(s) are provided ‘as is’.

Where services provided are not of an acceptable technical quality, making it unfit for the purpose of its specified use, then no fee or job-related costs are due to the Photographer. The Photographer has the right to rectify the defect causing the rejection within a reasonable time, having regard to the urgency of the work. If rectified, the Photographer is entitled to their fee and service related expenses but may or may not charge the Client an extra fee or cost for rectifying the defect. Furthermore, if the Photographer produces services that are in the same style and structure as the Photographer’s past work, by reference of the Photographer’s portfolio, the Client is deemed to have accepted the Photographer’s artistic interpretation.

Refunds:

Due to the unique and custom nature of the service and products offered, no refunds are available once images have been approved and delivered.

By hiring Loft Architectural and Real Estate Photography, you are bound by this contract and agree to comply with all aforementioned statements and policies.
